(יד) כִּֽי־תָבֹ֣א אֶל־הָאָ֗רֶץ אֲשֶׁ֨ר יְהוָ֤ה אֱלֹהֶ֙יךָ֙ נֹתֵ֣ן לָ֔ךְ וִֽירִשְׁתָּ֖הּ וְיָשַׁ֣בְתָּה בָּ֑הּ וְאָמַרְתָּ֗ אָשִׂ֤ימָה עָלַי֙ מֶ֔לֶךְ כְּכָל־הַגּוֹיִ֖ם אֲשֶׁ֥ר סְבִיבֹתָֽי׃ (טו) שׂ֣וֹם תָּשִׂ֤ים עָלֶ֙יךָ֙ מֶ֔לֶךְ אֲשֶׁ֥ר יִבְחַ֛ר יְהוָ֥ה אֱלֹהֶ֖יךָ בּ֑וֹ מִקֶּ֣רֶב אַחֶ֗יךָ תָּשִׂ֤ים עָלֶ֙יךָ֙ מֶ֔לֶךְ לֹ֣א תוּכַ֗ל לָתֵ֤ת עָלֶ֙יךָ֙ אִ֣ישׁ נָכְרִ֔י אֲשֶׁ֥ר לֹֽא־אָחִ֖יךָ הֽוּא׃ (טז) רַק֮ לֹא־יַרְבֶּה־לּ֣וֹ סוּסִים֒ וְלֹֽא־יָשִׁ֤יב אֶת־הָעָם֙ מִצְרַ֔יְמָה לְמַ֖עַן הַרְבּ֣וֹת ס֑וּס וַֽיהוָה֙ אָמַ֣ר לָכֶ֔ם לֹ֣א תֹסִפ֗וּן לָשׁ֛וּב בַּדֶּ֥רֶךְ הַזֶּ֖ה עֽוֹד׃ (יז) וְלֹ֤א יַרְבֶּה־לּוֹ֙ נָשִׁ֔ים וְלֹ֥א יָס֖וּר לְבָב֑וֹ וְכֶ֣סֶף וְזָהָ֔ב לֹ֥א יַרְבֶּה־לּ֖וֹ מְאֹֽד׃ (יח) וְהָיָ֣ה כְשִׁבְתּ֔וֹ עַ֖ל כִּסֵּ֣א מַמְלַכְתּ֑וֹ וְכָ֨תַב ל֜וֹ אֶת־מִשְׁנֵ֨ה הַתּוֹרָ֤ה הַזֹּאת֙ עַל־סֵ֔פֶר מִלִּפְנֵ֥י הַכֹּהֲנִ֖ים הַלְוִיִּֽם׃ (יט) וְהָיְתָ֣ה עִמּ֔וֹ וְקָ֥רָא ב֖וֹ כָּל־יְמֵ֣י חַיָּ֑יו לְמַ֣עַן יִלְמַ֗ד לְיִרְאָה֙ אֶת־יְהוָ֣ה אֱלֹהָ֔יו לִ֠שְׁמֹר אֶֽת־כָּל־דִּבְרֵ֞י הַתּוֹרָ֥ה הַזֹּ֛את וְאֶת־הַחֻקִּ֥ים הָאֵ֖לֶּה לַעֲשֹׂתָֽם׃ (כ) לְבִלְתִּ֤י רוּם־לְבָבוֹ֙ מֵֽאֶחָ֔יו וּלְבִלְתִּ֛י ס֥וּר מִן־הַמִּצְוָ֖ה יָמִ֣ין וּשְׂמֹ֑אול לְמַעַן֩ יַאֲרִ֨יךְ יָמִ֧ים עַל־מַמְלַכְתּ֛וֹ ה֥וּא וּבָנָ֖יו בְּקֶ֥רֶב יִשְׂרָאֵֽל׃ (ס)
(14) If, after you have entered the land that the LORD your God has assigned to you, and taken possession of it and settled in it, you decide, “I will set a king over me, as do all the nations about me,” (15) you shall be free to set a king over yourself, one chosen by the LORD your God. Be sure to set as king over yourself one of your own people; you must not set a foreigner over you, one who is not your kinsman. (16) Moreover, he shall not keep many horses or send people back to Egypt to add to his horses, since the LORD has warned you, “You must not go back that way again.” (17) And he shall not have many wives, lest his heart go astray; nor shall he amass silver and gold to excess. (18) When he is seated on his royal throne, he shall have a copy of this Teaching written for him on a scroll by the levitical priests. (19) Let it remain with him and let him read in it all his life, so that he may learn to revere the LORD his God, to observe faithfully every word of this Teaching as well as these laws. (20) Thus he will not act haughtily toward his fellows or deviate from the Instruction to the right or to the left, to the end that he and his descendants may reign long in the midst of Israel.
(יא) וַיֹּאמֶר זֶה יִהְיֶה מִשְׁפַּט הַמֶּלֶךְ אֲשֶׁר יִמְלֹךְ עֲלֵיכֶם אֶת בְּנֵיכֶם יִקָּח וְשָׂם לוֹ בְּמֶרְכַּבְתּוֹ וּבְפָרָשָׁיו וְרָצוּ לִפְנֵי מֶרְכַּבְתּוֹ. (יב) וְלָשׂוּם לוֹ שָׂרֵי אֲלָפִים וְשָׂרֵי חֲמִשִּׁים וְלַחֲרֹשׁ חֲרִישׁוֹ וְלִקְצֹר קְצִירוֹ וְלַעֲשׂוֹת כְּלֵי מִלְחַמְתּוֹ וּכְלֵי רִכְבּוֹ. (יג) וְאֶת בְּנוֹתֵיכֶם יִקָּח לְרַקָּחוֹת וּלְטַבָּחוֹת וּלְאֹפוֹת. (יד) וְאֶת שְׂדוֹתֵיכֶם וְאֶת כַּרְמֵיכֶם וְזֵיתֵיכֶם הַטּוֹבִים יִקָּח וְנָתַן לַעֲבָדָיו. (טו) וְזַרְעֵיכֶם וְכַרְמֵיכֶם יַעְשֹׂר וְנָתַן לְסָרִיסָיו וְלַעֲבָדָיו. (טז) וְאֶת עַבְדֵיכֶם וְאֶת שִׁפְחוֹתֵיכֶם וְאֶת בַּחוּרֵיכֶם הַטּוֹבִים וְאֶת חֲמוֹרֵיכֶם יִקָּח וְעָשָׂה לִמְלַאכְתּוֹ. (יז) צֹאנְכֶם יַעְשֹׂר וְאַתֶּם תִּהְיוּ לוֹ לַעֲבָדִים. (יח) וּזְעַקְתֶּם בַּיּוֹם הַהוּא מִלִּפְנֵי מַלְכְּכֶם אֲשֶׁר בְּחַרְתֶּם לָכֶם וְלֹא יַעֲנֶה יְהוָה אֶתְכֶם בַּיּוֹם הַהוּא. (יט) וַיְמָאֲנוּ הָעָם לִשְׁמֹעַ בְּקוֹל שְׁמוּאֵל וַיֹּאמְרוּ לֹּא כִּי אִם מֶלֶךְ יִהְיֶה עָלֵינוּ. (כ) וְהָיִינוּ גַם אֲנַחְנוּ כְּכָל הַגּוֹיִם וּשְׁפָטָנוּ מַלְכֵּנוּ וְיָצָא לְפָנֵינוּ וְנִלְחַם אֶת מִלְחֲמֹתֵנוּ. (כא) וַיִּשְׁמַע שְׁמוּאֵל אֵת כָּל דִּבְרֵי הָעָם וַיְדַבְּרֵם בְּאָזְנֵי יְהוָה. (כב) וַיֹּאמֶר יְהוָה אֶל שְׁמוּאֵל שְׁמַע בְּקוֹלָם וְהִמְלַכְתָּ לָהֶם מֶלֶךְ וַיֹּאמֶר שְׁמוּאֵל אֶל אַנְשֵׁי יִשְׂרָאֵל לְכוּ אִישׁ לְעִירוֹ.

(11) And he said: ‘This will be the manner of the king that shall reign over you: he will take your sons, and appoint them to him, for his chariots, and to be his horsemen; and they shall run before his chariots. (12) And he will appoint them to him for captains of thousands, and captains of fifties; and to plow his ground, and to reap his harvest, and to make his instruments of war, and the instruments of his chariots. (13) And he will take your daughters to be perfumers, and to be cooks, and to be bakers. (14) And he will take your fields, and your vineyards, and your oliveyards, even the best of them, and give them to his servants. (15) And he will take the tenth of your seed, and of your vineyards, and give to his officers, and to his servants. (16) And he will take your men-servants, and your maid-servants, and your best young men, and your asses, and put them to his work. (17) He will take the tenth of your flocks; and you shall be his servants. (18) And you shall cry out in that day because of your king who you shall have chosen; and the LORD will not answer you in that day.’ (19) But the people refused to listen to the voice of Samuel; and they said: ‘No; but there shall be a king over us; (20) that we also may be like all the nations; and that our king may judge us, and go out before us, and fight our battles.’ (21) And Samuel heard all the words of the people, and he spoke them in the ears of the LORD. (22) And the LORD said to Samuel: ‘Listen to their voice, and make them a king.’ And Samuel said to the men of Israel: ‘Go you every man to his city.’

המלך לא דן ולא דנין אותו, לא מעיד ולא מעידין אותו

אלא מלכי ישראל מ"ט לא

משום מעשה שהיה דעבדיה דינאי מלכא קטל נפשא

אמר להו שמעון בן שטח לחכמים תנו עיניכם בו ונדוננו

שלחו ליה עבדך קטל נפשא שדריה להו שלחו לי' תא אנת נמי להכא (שמות כא, כט) והועד בבעליו אמרה תורה יבא בעל השור ויעמוד על שורו

אתא ויתיב א"ל שמעון בן שטח ינאי המלך עמוד על רגליך ויעידו בך ולא לפנינו אתה עומד אלא לפני מי שאמר והיה העולם אתה עומד שנאמר (דברים יט, יז) ועמדו שני האנשים אשר להם הריב וגו'

אמר לו לא כשתאמר אתה אלא כמה שיאמרו חבריך

נפנה לימינו כבשו פניהם בקרקע נפנה לשמאלו וכבשו פניהם בקרקע

אמר להן שמעון בן שטח בעלי מחשבות אתם יבא בעל מחשבות ויפרע מכם

מיד בא גבריאל וחבטן בקרקע ומתו

באותה שעה אמרו מלך לא דן ולא דנין אותו לא מעיד ולא מעידין אותו

[Mishnah] A King is not judged, nor does he serve as judge. He does not give testimony, nor does he testify.

[Gemara] Why isn't a king judged?

Because of an incident that occurred when King Yannai's servant killed someone.

Shimon Ben Shetach said to his fellow sages, pay attention to this matter and let us adjudicate!

They send Yannai a message, "Your servant has killed someone. Come before us here and testify as the Torah commands."

Yannai came and said before them. Shimon Ben Shetach said to him, "Yannai the King, stand on your feet and give testimony. And it is not before us that you that, but rather before the One who spoke and created the world, you stand.

Yannai replied, "I will not do as you say, but rather as your fellow judges command."

Shimon ben Shetach turned to his right, and the judges cast their eyes to the ground. He turned to his left, and those judges cast their eyes to the ground as well.

Shimon ben Shetach said to them, "Deep thinkers you all must be! Let the Master of Thoughts come and punish you."

Immediately, Gabriel came, struck them down, and they died.

At that moment, they declared, "A king is not judged, nor does he serve as judge. Does not testify, nor is he testified against."

(לד) וַיֹּ֤אמֶר דָּוִד֙ אֶל־שָׁא֔וּל רֹעֶ֨ה הָיָ֧ה עַבְדְּךָ֛ לְאָבִ֖יו בַּצֹּ֑אן וּבָ֤א הָֽאֲרִי֙ וְאֶת־הַדּ֔וֹב וְנָשָׂ֥א שֶׂ֖ה מֵהָעֵֽדֶר׃ (לה) וְיָצָ֧אתִי אַחֲרָ֛יו וְהִכִּתִ֖יו וְהִצַּ֣לְתִּי מִפִּ֑יו וַיָּ֣קָם עָלַ֔י וְהֶחֱזַ֙קְתִּי֙ בִּזְקָנ֔וֹ וְהִכִּתִ֖יו וַהֲמִיתִּֽיו׃

(34) And David said unto Saul: ‘Thy servant kept his father’s sheep; and when there came a lion, or a bear, and took a lamb out of the flock, (35) I went out after him, and smote him, and delivered it out of his mouth; and when he arose against me, I caught him by his beard, and smote him, and slew him.
