About This Text
Author: Eliezer Berkovits
HaHalakhah: Kochah VeTafkidah (Jewish Law: Its Authority and Function) is a late 20th-century Hebrew work by Rabbi Dr. Eliezer Berkovits. In it, Berkovits analyzes the essence and role of Jewish law in his generation, given the unprecedented events of the Holocaust and the establishment of the State of Israel. Berkovits sees halakhah as the backbone of Jewish continuity and argues that the creative power of talmudic and halakhic texts can revive the holiness inherent in the secular State of Israel. Scholars of Torah, by extension, are charged with the task of internalizing and demonstrating how halakhah can be a driving force in shaping a just and ethical society.
