Sending Out of Impure People
Laws of Impurity and Purity
Sources
A
The area within the wall [of Jerusalem] is holier, for it is there that lesser holy things and second tithe may be eaten. The Temple Mount is holier, for zavim, zavot, menstruants and women after childbirth may not enter it. The chel is holier, for neither non-Jews nor one who contracted corpse impurity may enter it. The court of women is holier, for a tevul yom may not enter it, though he is not obligated a hatat for doing so. The court of the Israelites is holier, for a man who has not yet offered his obligatory sacrifices may not enter it, and if he enters he is liable for a hatat…
Mishnah Kelim 1:8
“And they shall send out from the camp” – from the camp of the Divine Presence. It teaches that lepers and those impure due to corpses are sent out of there. “Leper” – this is a quarantined one; “every leper” – this is a confirmed one. “
Zav
” – this is a full-fledged
zav
; “every
zav
” – to include a
zav
who experienced two sightings; “and every
zav
” – to include a
zav
who experienced one sighting. “Impure by means of a corpse” – this is a person, who can be sent out; “every one impure” – to include vessels that come in contact with a corpse…
Bamidbar Rabbah 7:8
Having cited verses dealing with the requirement to send out the ritually impure from the camp, the Gemara addresses several
halakhot
relevant to that topic.
Rav Ḥisda said: A leper,
who must be sent out from all of the camps including the Israelite camp,
who went in beyond his boundary,
that is, he entered an area that is prohibited to him,
is
nonetheless
exempt
from the punishment of lashes. With regard to the ritually impure, the Torah states: “Both male and female shall you send out, outside the camp shall you send them…
Pesachim 67a:7-13
וישלחו מן המחנה [COMMAND THE CHILDREN OF ISRAEL] THAT THEY SEND AWAY FROM THE CAMP [EVERY LEPER etc.] — There were three camps one within the other whenever they encamped: the area within the hangings was the “camp of the Shechinah”, the encampment of the Levites round about this, as is described in the Sedrah במדבר סיני (Numbers 1:53), was the “camp of the Levites”, and from there outward up to the end of the encampment of the divisions in all the four directions was the “camp of the Israelites”…
Rashi on Numbers 5:2:2
If an unclean person stood under a tree and a clean person passed by, the latter becomes unclean. If a clean person stood under a tree and an unclean one passed by, the former remains clean. If the latter stood still, the former becomes unclean. Similarly in the case of a leprous stone he remains clean. But if it was set down he becomes unclean.
Mishnah Negaim 13:7
AND THEY SHALL SEND AWAY FROM THE CAMP EVERY LEPER etc. After he [Moses] had erected the Tabernacle, He commanded that the impure should be sent away from the camp in order that the camp should be holy and fit for the Divine Presence to reside therein, this being a commandment which was applicable immediately and in [all subsequent] generations. And because He counted Israel
after their families, by the house of their fathers
, and separated from them the mixed multitude which was among them…
Ramban on Numbers 5:2:1
It is from the roots of the commandment [that it is] because it is known to the Sages that the matter of impurity weakens the power of the intellect and mixes it up and separates between it and the pure and perfect Elevated Understanding. And it will be separated until it is purified. And [it is] as it is written regarding the matter of impurity (Leviticus 11:43), “and do not become impure with them and be impurified (
venitmetem
) in them” — and they, may their memory be blessed, expounded (Yoma 39a), “and be stupefied (
venitamtem
) in them”…
Sefer HaChinukh 362:2
Variantly: (The verse speaks of one who passes his son or daughter (through the halves of a calf), thereby entering into a covenant (with idolatry), as it is written (Jeremiah 34:18) "the calf which they cut in two so as to pass between its halves." Variantly: "one who passes his son or daughter through fire": (The verse speaks of) one who cohabits with an Aramite woman and begets through her a son who is a foe of the L-rd.
