Rabbi Chiyya b. Abba

R. Chiyya b. Abba (II) came from Babylonia and studied under R. Yochanan in Tiberias. Due to poverty and various conflicts, he moved a great deal. Due to his piety, his prayers were known to be particularly effective.

Rav Naḥman and Rava sent this issue before Rabbi Ami. He sent a response to them: The agency did not return to the husband, and the divorce does not take effect. And Rabbi Ḥiyya bar Abba says: We will consider the matter and then respond. Later they again sent this issue before Rabbi Ḥiyya bar Abba. He said: All these times they continue to send questions? Just as the matter is uncertain to them, so too, it is uncertain to us, and I do not have a resolution to the uncertainty.

Gittin 63b:14-15

With regard to this difference of opinion Rabbi Zeira said: Take this statement of Rabbi Ḥiyya bar Abba in your hand, as he is scrupulous and he learned the halakha well from the mouth of its originator, like the Sage Raḥava from the city Pumbedita. Berakhot 33b:12

The Gemara recounts a related incident: When Rav Ashi would lend money and wish to write a prosbol he would transfer to the borrower a stump of a palm tree that was still attached to the ground, and he wrote a prosbol based on this. Shmuel says: All creeping animals possess venom; that of a snake kills, whereas the venom of other creeping animals does not kill. Shmuel said to Ḥiyya bar Rav: Son of a lion! Come and I will say to you a superior matter that your father, Rav, said. This is what your father said: These Arameans are swollen [zukanei] because they drink exposed liquids, but they did not die from doing so since they eat repugnant creatures and creeping animals, which heat their bodies and thereby render them less susceptible to the venom.

RABBI CHIYA BAR ABA HACOHEN is not to be confused with the Tana Rabbi Chiya Raba who lived four generations earlier during the time of Rabbi Jehudah Hanasi.
