MISHNAH: How do they free their co-wives? If a man’s daughter or one of the incest-prohibited women165Forbidden to him but not to his brother. was married to his brother who has another wife and dies, just as his daughter is free so her co-wife is free166If the man is the only brother of the deceased.. If his daughter’s co-wife went and was married to a second brother167Since the daughter is not forbidden to his brother, her co-wife is also permitted. The brother could have married his niece in levirate. who then died, just as his daughter’s co-wife is freed, so the co-wife’s co-wife is freed; even if this is repeated a hundred times.
הלכה: כֵּיצַד פּוֹטְרוֹת צָרוֹתֵיהֶן. הָֽיְתָה בִתּוֹ אוֹ אַחַת מִכָּל־הָעֲרָיוֹת הָאֵילּוּ כול׳. הִיא מַתְנִיתָא כָּל־הַיְּכוֹלוֹת לְמָאֵן וְלֹא מֵיאֵנָה צָרָתָהּ חוֹלֶצֶת וְלֹא מִתְיַבֶּמֶת. HALAKHAH: “How do they free their co-wives? If a man’s daughter or one of the incest-prohibited women,”, etc. That is the baraita168This is not the text of the next Mishnah since here the daughter is still alive. A similar text is in Tosephta 1:2. It refers to the second case in the Mishnah, if there are at least three brothers. If there is only one brother and the daughter is still a minor one might teach her to repudiate the former marriage (cf. Mishnah 13:7) and her co-wife will be permitted to her father.: “If a woman could repudiate but did not do so, her co-wife performs ḥalîṣah but cannot be married in levirate127To the brothers in levirate. The marriage of a minor except through the father is only rabbinic and cannot eliminate the biblical requirement of levirate or ḥalîṣah. But levirate cannot be tolerated since that would show that the rabbinically valid marriage is a sham..”
